Terms of sale

These terms apply when you buy from the Enhance-d Club shop at https://shop.enhance-d.com. Please read them with our Shipping and delivery, Refund and returns and Privacy pages, which form part of them.

1. Who we are

The shop is run by Enhance-d Club UK, a trading name of Shifting the Perception of Type One Diabetes CIC, a community interest company registered in England and Wales (company number 15401822).

We are not VAT registered, so our prices do not include VAT charged by us. Some suppliers’ prices include their own UK VAT, which we pass on at cost.

The names Enhance-d, Enhance-d Club and Enhance-d Club UK are used under licence from Sestante Analytics AG.

2. What we sell

• Bioracer club kit: cycling, triathlon and athletics kit made to order for the Enhance-d Club by Bioracer in Belgium, in batches (see section 5).
• Printed clothing and gear: printed to order for you by our partner Printful.
• Products sold by others: some products, such as our book, link to another seller (for example Amazon). That seller takes the order and its terms apply.

Product photos and colours are as accurate as we can make them, but screens and fabrics vary. Sizes are on each product page; please check the size guide before ordering.

3. Ordering and our contract with you

1. Your order is an offer to buy. We accept it when we send you the order confirmation email, and that email forms our contract.
2. We may decline or cancel an order (with a full refund) if an item is unavailable, a price was clearly wrong, we cannot deliver to your address, or we suspect fraud.
3. Bioracer kit is sold in its own basket and cannot be combined with other products in one order.
4. You must be 18 or over, or have a parent or guardian’s permission, to order.

4. Prices and payment

1. Prices are shown in pounds sterling (GBP) and include the costs shown at checkout. Delivery is added at checkout.
2. You pay in full when you order. Payments are processed securely by our payment provider; we never see or store your full card details.
3. Enhance-d Club credit: members of the Enhance-d app can turn Club credits into a single-use code for this shop. A code has no cash value, can be used once before it expires (30 days), and any value not used on that order is lost. If an order paid partly with a code is refunded, we refund the amount you paid and return the credit to your Enhance-d app account.

5. Bioracer club kit: batches and timing

1. Kit is made to order in batches. Each calendar month is one batch: orders placed during the month go to Bioracer after the month ends, and the kit usually ships about 8 weeks after that. Your order confirmation email shows your batch date and an estimated delivery date.
2. Because kit is made to order, it takes longer than the 30 days the law assumes for delivery. By ticking the box at checkout you agree to this longer delivery time.
3. Estimates are not guaranteed: production and delivery depend on Bioracer and the carriers. If a batch is running late we will email you with a new estimate.
4. You can change sizes, or cancel your kit order for a full refund, at any time before your batch closes (the end of the month you ordered in). Reply to your confirmation email or write to shop@enhance-d.com.

6. Delivery

How and where we deliver, costs and import charges are on our Shipping and delivery page. The risk in the goods passes to you when they are delivered to you or to someone you nominate.

7. Cancellations, returns and faulty items

Your rights to cancel, return items and have faulty items put right are set out in our Refund and returns policy. Nothing in these terms affects your legal rights as a consumer, including your rights under the Consumer Rights Act 2015 if goods are faulty, not as described or not fit for purpose.

8. Our responsibility to you

1. If we break these terms we are responsible for loss or damage you suffer that is a foreseeable result of that, but not for loss that is not foreseeable.
2. We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for breach of your legal rights in relation to the goods.
3. We sell goods for personal use. We are not responsible for business losses.

9. Events outside our control

We are not responsible for delays caused by events outside our reasonable control, such as supplier or carrier disruption, strikes, customs hold-ups or extreme weather. We will tell you as soon as we can and keep you updated. This does not affect your legal rights.

10. Your information

We use your information as described in our Privacy policy.

11. Complaints and the law

If something goes wrong, please email shop@enhance-d.com and we will try to put it right quickly. These terms are governed by the law of England and Wales. If you live elsewhere in the UK or in the EU, you also keep the protection of the mandatory consumer law of the country where you live, and you may bring proceedings there.

12. Changes to these terms

We may update these terms from time to time. The terms that apply to your order are the ones shown on this page when you placed it.
